FlewIt Terms and Conditions
These Terms and Conditions are entered into between you and Skylife Technologies Ltd., a British Columbia, Canada company operating the FlewIt service.
In these Terms, “FlewIt,” “we,” “us,” and “our” refer to Skylife Technologies Ltd. The words “you” and “your” refer to the person accessing or using FlewIt.
By creating an account, accessing, or using FlewIt, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use FlewIt.
1. About FlewIt
FlewIt is a flight logging and aviation enthusiast platform that allows users to record, organize, view, and analyze flights they have taken.
FlewIt may include features such as flight logs, maps, statistics, badges, user dashboards, airline information, airport information, aircraft information, route information, and other aviation-related tools.
FlewIt is provided for personal, informational, entertainment, and aviation enthusiast purposes only. FlewIt is not an official aviation, airline, airport, government, travel, navigation, regulatory, operational, or safety tool.
2. Eligibility
You must be at least 13 years old to use FlewIt.
If you are under the age of majority in your province, state, territory, or country of residence, you may only use FlewIt with the permission of a parent or legal guardian.
By creating an account or using FlewIt, you confirm that you meet these eligibility requirements and that all information you provide is accurate, current, and complete.
3. Your Account
To use certain features of FlewIt, you may be required to create an account.
You agree to:
- provide accurate and current account information;
- maintain the security of your login credentials;
- not share your account with any other person;
- promptly update your account information if it changes; and
- notify us if you believe your account has been accessed without authorization.
You are responsible for all activity that occurs under your account.
We may suspend, restrict, or terminate your account if we reasonably believe that you have violated these Terms, misused FlewIt, created risk for FlewIt or other users, provided false information, or used the Service in a way that may cause harm to us, other users, or third parties.
4. User Content and Flight Data
FlewIt allows you to submit, enter, upload, store, or generate content and information, including flight logs, travel history, airline information, airport information, aircraft information, notes, profile information, preferences, and other data or content.
In these Terms, this is referred to as “User Content.”
You retain ownership of your User Content.
By submitting User Content to FlewIt, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, display, reproduce, modify, format, transmit, and use your User Content as reasonably necessary to operate, provide, maintain, improve, secure, and develop FlewIt.
This licence allows us to provide features such as flight logs, maps, dashboards, statistics, badges, analytics, account functionality, data backups, support, and related features.
You are responsible for the accuracy, legality, and appropriateness of your User Content.
You represent and warrant that you have the right to submit your User Content and that your User Content does not violate these Terms, applicable law, or the rights of any person or organization.
5. Accuracy of Aviation Information
FlewIt may display aviation-related information, including airport names, airport codes, airline names, aircraft types, flight routes, distances, durations, dates, maps, statistics, and other aviation data.
While we aim to provide a useful and accurate experience, this information may be incomplete, outdated, estimated, user-submitted, third-party-sourced, or subject to error.
You acknowledge that:
- FlewIt may contain errors or inaccuracies;
- flight distances, route lines, and map displays may be approximate;
- historical aviation data may contain gaps or inconsistencies;
- airline, airport, aircraft, and route information may change over time;
- statistics and badges may be calculated based on available or user-entered data; and
- FlewIt should not be relied upon for travel planning, aviation operations, navigation, safety decisions, regulatory compliance, or official records.
You are responsible for independently verifying any information before relying on it.
6. Maps, Routes, and Distance Calculations
FlewIt may display maps, flight paths, great circle routes, geographic information, and estimated distances between airports or locations.
These features are for visual, informational, and entertainment purposes only.
Map displays, route lines, geographic positions, and distances may be approximate and may not reflect actual flight paths, air traffic control routing, diversions, weather-related routing, airline-specific routing, or operational flight data.
7. Acceptable Use
You agree not to use FlewIt to:
- violate any law, regulation, or third-party right;
- upload, submit, or share unlawful, false, misleading, harmful, abusive, defamatory, obscene, offensive, or otherwise inappropriate content;
- impersonate another person or organization;
- access, use, or attempt to access another user’s account;
- interfere with the security, availability, performance, or integrity of FlewIt;
- introduce viruses, malware, harmful code, spam, or automated abuse;
- scrape, crawl, harvest, copy, or extract data from FlewIt without our written permission;
- reverse engineer, decompile, copy, modify, or create derivative works from FlewIt except where permitted by law;
- use FlewIt to build, train, or improve a competing product or service without our written permission;
- use FlewIt for unauthorized commercial resale, data brokerage, or bulk data extraction;
- attempt to bypass usage limits, payment requirements, access controls, or security features; or
- use FlewIt in any way that could harm us, our users, our systems, or third parties.
We may remove content, restrict features, suspend accounts, or terminate access if we reasonably believe these rules have been violated.
8. Free and Paid Plans
FlewIt may offer free plans, paid subscription plans, promotional plans, or other paid features.
The features, limits, pricing, billing frequency, renewal terms, taxes, and cancellation options for paid plans will be shown at checkout, in your account, or otherwise made available to you before purchase.
We may add, remove, modify, or discontinue plans or features from time to time.
Certain features may be limited to paid users or subject to usage limits.
9. Billing and Payments
If you purchase a paid subscription or paid feature, you authorize FlewIt and its payment processors to charge your selected payment method for all applicable fees, taxes, renewals, and other charges disclosed to you.
Subscription fees are generally billed in advance unless otherwise stated.
You are responsible for ensuring that your payment information is accurate and up to date.
If a payment fails, we may suspend or restrict access to paid features until payment is completed.
We use third-party payment processors to process payments. We do not directly store full payment card details unless expressly stated otherwise. Your payment may also be subject to the payment processor’s own terms and privacy policy.
10. Automatic Renewals
If you purchase a subscription, your subscription may automatically renew at the end of each billing period unless you cancel before the renewal date.
By purchasing a subscription, you authorize us and our payment processor to charge your payment method on a recurring basis according to the billing cycle disclosed to you at checkout.
You may cancel your subscription through your account settings or by contacting us at crew@flewit.com.
11. Cancellations
You may cancel your paid subscription at any time.
Cancellation stops future billing but does not automatically refund fees already paid unless required by law or expressly stated by us.
After cancellation, you may continue to access paid features until the end of your current billing period, unless otherwise stated or unless your account is suspended or terminated for violation of these Terms.
12. Refunds
Unless otherwise stated at the time of purchase or required by applicable law, payments are non-refundable.
We may, at our discretion, provide refunds, credits, or exceptions in certain cases.
Nothing in these Terms limits any refund or cancellation rights you may have under laws that cannot be excluded by contract.
13. Free Trials, Promotions, Referrals, and Promo Codes
FlewIt may offer free trials, discounts, promotional codes, referral offers, affiliate offers, or other promotions.
Promotions may be subject to additional terms, including expiry dates, eligibility requirements, usage limits, geographic restrictions, plan restrictions, or one-time-use limitations.
We may modify, suspend, or cancel promotions at any time unless prohibited by law.
Promo codes and referral offers have no cash value unless expressly stated.
14. Account Deletion and Data Export
You may request deletion of your account by using account deletion tools, if available, or by contacting us at crew@flewit.com.
Before deleting your account, you may wish to export or save your flight log data if export functionality is available.
After account deletion, we may retain certain information where reasonably necessary for legal, security, fraud prevention, backup, tax, accounting, dispute resolution, or legitimate business purposes, as described in our Privacy Policy.
Deletion of your account may permanently remove your flight logs, profile information, statistics, badges, preferences, and other account data from active systems.
15. Privacy
Your use of FlewIt is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, store, transfer, and protect personal information.
By using FlewIt, you acknowledge that you have reviewed our Privacy Policy.
If there is a conflict between these Terms and the Privacy Policy regarding the handling of personal information, the Privacy Policy will apply to the extent of that conflict.
16. Cookies, Analytics, and Tracking
FlewIt may use cookies, pixels, local storage, analytics tools, affiliate tracking, referral tracking, session cookies, and similar technologies.
These technologies may be used to operate FlewIt, keep users logged in, remember preferences, improve the Service, measure usage, support affiliate or referral programs, prevent fraud, and understand how users interact with FlewIt.
More information about our use of cookies and similar technologies should be provided in our Privacy Policy or Cookie Policy.
Where required by law, we will request consent for certain cookies or tracking technologies.
17. Email Communications
We may send you transactional or service-related emails, including account verification emails, password reset emails, billing notices, subscription notices, security alerts, account updates, and important service announcements.
These communications are necessary for the operation of FlewIt and may not always include an unsubscribe option.
We may also send marketing or promotional emails if you have consented to receive them or where otherwise permitted by law.
You may unsubscribe from marketing emails at any time by using the unsubscribe link in the email or by contacting us.
18. Third-Party Services and Data Sources
FlewIt may rely on, integrate with, or link to third-party services, including payment processors, hosting providers, map providers, analytics tools, email providers, authentication providers, aviation data sources, airport databases, airline databases, aircraft databases, and other service providers.
We are not responsible for third-party services, websites, content, datasets, policies, errors, outages, security practices, or actions.
Your use of third-party services may be subject to their own terms and privacy policies.
We do not guarantee the accuracy, completeness, availability, or reliability of any third-party data or service.
19. Intellectual Property
FlewIt, including its name, logo, branding, designs, software, source code, databases, interface, layouts, text, graphics, icons, badges, features, functionality, and other materials, is owned by Skylife Technologies Ltd. or its licensors and is protected by intellectual property laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, license, publicly display, publicly perform, create derivative works from, reverse engineer, or otherwise exploit any part of FlewIt without our prior written permission.
Nothing in these Terms transfers ownership of FlewIt intellectual property to you.
20. Limited Licence to Use FlewIt
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use FlewIt for your personal, non-commercial use.
This licence does not allow you to:
- resell FlewIt;
- commercially exploit FlewIt;
- copy or modify FlewIt;
- use FlewIt for a competing service;
- extract or reuse substantial portions of FlewIt’s data; or
- use FlewIt in a manner not permitted by these Terms.
We may revoke this licence if you violate these Terms.
21. Feedback and Suggestions
If you provide feedback, ideas, suggestions, feature requests, designs, improvements, bug reports, or recommendations about FlewIt, you agree that we may use them without restriction, obligation, or compensation to you.
This includes ideas relating to features, dashboards, maps, badges, aviation data, analytics, design, pricing, or functionality.
22. Service Availability and Changes
We may update, modify, suspend, restrict, or discontinue all or part of FlewIt at any time.
We do not guarantee that FlewIt will always be available, uninterrupted, secure, accurate, or error-free.
We may perform maintenance, upgrades, security changes, or technical updates that temporarily affect access to FlewIt.
We are not liable for any loss or inconvenience resulting from downtime, data errors, service interruptions, or changes to FlewIt, except where liability cannot be excluded by law.
23. Beta and Experimental Features
FlewIt may offer beta, experimental, early-access, preview, or test features.
These features may be incomplete, inaccurate, unstable, or discontinued at any time.
You use beta and experimental features at your own risk.
We may modify or remove beta features without notice.
24. Disclaimer of Warranties
FlewIt is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and security.
We do not warrant that:
- FlewIt will meet your expectations;
- FlewIt will be uninterrupted, timely, secure, or error-free;
- aviation data will be accurate, complete, or current;
- maps, routes, statistics, badges, or calculations will be free from errors;
- defects will be corrected;
- FlewIt will be free from viruses or harmful components; or
- any information obtained through FlewIt will be reliable for your intended purpose.
25. Not an Official Aviation Record
FlewIt is not an official aviation recordkeeping system.
Your FlewIt account, flight logs, statistics, maps, badges, or exported data should not be treated as official proof of travel, official aviation history, regulatory documentation, airline records, immigration records, tax records, or legal evidence unless independently verified.
You are responsible for maintaining any records you may require for legal, tax, immigration, employment, travel, insurance, or other official purposes.
26. Limitation of Liability
To the maximum extent permitted by law, Skylife Technologies Ltd., FlewIt, and their owners, directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including loss of profits, loss of data, loss of goodwill, business interruption, loss of use, or loss of opportunity.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to FlewIt or these Terms will not exceed the greater of:
- the amount you paid to FlewIt in the twelve months before the claim arose; or
- CAD $100.
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you.
27. Indemnity
You agree to indemnify and hold harmless Skylife Technologies Ltd., FlewIt, and their owners, directors, officers, employees, contractors, affiliates, licensors, and service providers from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your access to or use of FlewIt;
- your User Content;
- your violation of these Terms;
- your violation of applicable law;
- your violation of any third-party right;
- your misuse of aviation, airline, airport, aircraft, map, or route information; or
- your unauthorized use of another person’s account or information.
28. Suspension and Termination
You may stop using FlewIt at any time.
We may suspend, restrict, or terminate your access to FlewIt if:
- you violate these Terms;
- you create legal, security, operational, technical, or reputational risk;
- your payment fails and remains unresolved;
- required by law;
- we discontinue all or part of FlewIt;
- we reasonably believe your account has been compromised; or
- we reasonably believe your use may harm us, other users, or third parties.
Upon termination, your right to access and use FlewIt will immediately end.
Certain sections of these Terms will continue to apply after termination, including sections relating to intellectual property, user content licences, disclaimers, limitation of liability, indemnity, governing law, dispute resolution, and any other provisions that by their nature should survive termination.
29. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will take reasonable steps to notify you, such as by email, in-app notice, account notice, or posting an updated version on our website.
The updated Terms will be effective as of the date stated at the top of the Terms, unless otherwise stated.
Your continued use of FlewIt after the updated Terms take effect means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using FlewIt.
30. Local Law Rights
FlewIt is operated from British Columbia, Canada.
We do not represent that FlewIt is appropriate, available, or lawful in every jurisdiction.
If you access or use FlewIt from outside Canada, you are responsible for complying with local laws that apply to you.
Some jurisdictions provide consumers with mandatory rights that cannot be limited, waived, or excluded by contract. Nothing in these Terms is intended to limit any rights you may have under laws that cannot be excluded by contract.
31. Governing Law
These Terms and any dispute, claim, or matter arising from or relating to FlewIt are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles.
Subject to any rights you may have under laws that cannot be excluded by contract, you agree that the courts located in British Columbia, Canada will have exclusive jurisdiction over any dispute arising from or relating to these Terms or FlewIt.
32. Informal Dispute Resolution
Before starting a legal claim, you agree to first contact us at legal@flewit.com and attempt to resolve the dispute informally.
We will also attempt to resolve disputes with you informally where reasonable.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where appropriate.
33. Severability
If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be interpreted or modified to the minimum extent necessary to make it enforceable.
If it cannot be modified, it will be severed from these Terms.
The remaining sections will continue in full force and effect.
34. No Waiver
If we do not enforce any part of these Terms, that does not mean we waive our right to enforce it later.
Any waiver must be in writing to be effective.
35. Assignment
You may not assign or transfer these Terms or your account without our prior written permission.
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, change of control, or by operation of law.
36. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented to you for specific features or purchases, form the entire agreement between you and us regarding your use of FlewIt.
They replace any prior agreements, understandings, or communications relating to the same subject matter.
